What is the law on collective debt settlements?
If you are unable to settle your debts, perhaps the legal regulation in the framework of the law on collective debt settlements might provide a solution. To this end you have to submit a request to the court. The competent judge will decide, among others, how the debt was created and will examine whether no possibilities of settlement with the creditors could be reached. If fraud is involved, irresponsible buying behaviour, earlier debt rehabilitation or bankruptcy, the request can be denied.
If the judge decides that you can handle the obligations of the debt rehabilitation, a debt mediator will be appointed. With the help of a debt mediator a payment plan is subsequently agreed with the various creditors. The debt mediator will check if you comply with all agreements.
I’m involved in a collective debt settlement and I have received a letter from Universum Inkasso. What should I do?
You should give our collection letter to your debt mediator and ask them to contact Universum Inkasso (preferably in writing). The same applies if you are already in touch with an intermediary or mediating body (for example the OCMW, a social worker or a lawyer).
